Who Can File a Consumer Complaint?
Under the Consumer Protection Act, 2019, any person who buys goods or avails services for consideration (payment) can file a complaint. This includes individuals, Hindu Undivided Families (HUF), and companies. Even a person who uses the goods with the buyer's permission can file.

Filing Process in Kolkata
- Draft the complaint: State facts clearly — what was purchased, from whom, when, the defect/deficiency, and the relief sought (refund, replacement, compensation).
- Pay the court fee: Fee depends on claim value — ranging from ₹100 to ₹5000 (as per Consumer Protection Rules).
- File at the District Commission: Kolkata has multiple District Commissions. File where the seller resides or where the cause of action arose.
- Notice to opposite party: The Commission issues notice. The opposite party must respond within 30 days (extendable by 15 days).
- Hearing and order: The Commission hears both sides and passes an order. The entire process is designed to be completed within 3-5 months.
